The Committee of Ministers' supervision of the execution of judgments

The Committee of Ministers supervises the Council of Europe's member states’ execution of judgments of the European Court of Human Rights. In 2008 , for the first time,   an   annual report on the Committee of Ministers’ supervision was published. An on line database on the state of execution of judgments of the Court has also been established.

The Convention for the Protection of Human Rights and Fundamental Freedoms  was adopted by the Council of Europe’s member states in 1950. While the European Court of Human Rights observes the member states’ compliance with their obligations under the Convention through legally binding judgments, the Committee of Ministers supervises the execution of the Court’s judgments. 

 

The Committee of Ministers examines whether any just satisfaction awarded by the Court has been paid to the applicant, including, as the case may be, default interest. If required, it also examines whether other individual measures have been taken to ensure that the violation has ceased and that the injured party is put, as far as possible, in the same situation as he was before the violation of the Convention ocurred. Finally, it examines the adoption of general measures, with a view to preventing new violations similar to that or those found by the Court, or putting an end to continuing violations.

A first annual report on the Committee of Ministers’ supervision of judgments was published in 2008 as a result of a proposal submitted by Norway during its chairmanship of the Committee in 2004. The report can be found on the Council of Europe's web site dedicated to the execution of judgments.
